THC Drinks Face A Federal Deadline That Could Upend The Market
A federal law scheduled to take effect on November 12, 2026, will change the definition of hemp for finished cannabinoid products. Products containing more than 0.4 milligrams of total THC and similar intoxicating cannabinoids per container will no longer qualify as hemp and could instead be subject to federal marijuana laws. Most hemp-derived THC beverages currently sold in mainstream retail exceed that threshold. THC beverage sales reached $239 million during the 52 weeks ending June 27, 2026, while proposals to delay implementation remain under consideration in Congress.
